At the end of the tenancy the tenant must leave the premises reasonably clean and tidy and remove all rubbish. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The landlord provided photographic evidence of the state of the premises at the end of the tenancy. Having reviewed this evidence, it is clear that the tenant did leave the premises reasonably clean and tidy except for some drawings on the walls and a small number of items which were not removed.
It is appropriate to award a sum of $200.00 for the cleaning on the basis that this represents eight hours of cleaning at $25.00 per hour.
The amount charged for the removal of the remaining chattels seems unusually high for the nature and volume of items left behind. It is appropriate to award a sum that is in keeping with invoices which the Tribunal regularly sees for removing similar volumes of rubbish in this area.

The tenant accepted responsibility for the amount charged for the repair of one hole in a wall.
Since being notified by the landlord of its claims, the tenant has responsibly been paying funds to the landlord so that all amounts are now paid for. The landlord advised that it was obliged to make its application so that an Order was made as to the compensation payable.
There is no public interest in the publication of the tenant’s name in these circumstances given her willingness to accept responsibility, the fact that the sum involved was small and has now been fully paid.
