- This application was scheduled to be heard by video conference. The tenant did not connect to the Teams link provided to him and nor did he ring in to the hearing. The hearing proceeded in his absence.
- The background to this claim is that the tenant signed a fixed term tenancy agreement which started on 5 December 2025 and was due to expire on 27 November 2026.
- The tenant broke the fixed term and the landlord now makes an application to the Tribunal seeking rent arrears, cleaning costs, the break lease fee and reimbursement of the filing fee.
How much does the tenant owe?
- When a tenant breaks a fixed term tenancy early, they are required to pay rent to the expiry of the fixed term or to the date that a new tenant is found, whichever is the earlier.
- I accept the evidence provided today indicating that a new tenancy started at the premises on 8 January 2026.
- The tenant is therefore liable to pay rent to 7 January 2026 - $1,658.57.
- A tenant is also required to pay the reasonable costs to the landlord of finding a new tenant.
- At today’s hearing I accepted these costs as being $573.85. This included the cost of a viewing, administration, advertising and credit checks.
- When vacating a tenancy, tenants are required to leave premises reasonably clean and to remove all rubbish.
- The photographs show that these premises were not left reasonably clean and there was rubbish left behind.
- I accept the invoiced cost of $161.00 as being reasonable to remedy these issues.
- Further to this, the landlord was wholly successful with this claim against the tenant and so the tenant is required to reimburse the filing fee to the landlord. C ter Haar 23 April 2026
