Order
- The tenancy of Young Kim at 42 Lyons Avenue, Murrays Bay, Auckland 0630 is terminated, and possession is granted to Global Property Limited As Agent For Desmond Ling, as at 3 February 2026.
- The Bond Centre is to pay the bond of $3,280.00 (BN-17064839) to Global Property Limited As Agent For Desmond Ling immediately.
- Young Kim must pay Global Property Limited As Agent For Desmond Ling $1,222.78 immediately, calculated as shown in the table below:
Reasons
- The landlord attended the hearing via remote video conference. The tenant did not join the hearing via the video or telephone link as instructed in the notice of hearing. The hearing continued in the absence of the tenant.
- The landlord has applied for termination of the tenancy for abandonment, rent and water arrears and refund of the bond.
Should the tenancy be terminated?
- The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
- On 3 February 2026 the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. The landlord attended the property on this date and could see that the premises were empty and had been abandoned.
- Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.
How much does the tenant owe?
- The landlord provided rent records and Watercare invoices which prove the amount owing at the end of the tenancy. The amount ordered includes rent in lieu of notice.
- Having sighted the landlord’s evidence in respect of outstanding rent and water charges I am satisfied that the tenant is responsible for the debt.
- The claims for outstanding rent and water charges are established.
- The landlord will need to file a new application along with supporting evidence in respect of any vacated damage compensation claims.
- Because Global Property Limited As Agent For Desmond Ling has wholly succeeded with the claim I must reimburse the filing fee.
