The hearing was held by video conference on 17 June 2026. The landlord attended. The tenant did not attend.
I am satisfied that the tenant was given adequate notice of the hearing. I considered it fair and reasonable to proceed in the tenant’s absence. 5440834 2 Background
The tenancy started on 9 April 2024 and ended on 30 September 2025. The landlord has filed a claim for compensation following the end of the tenancy.
The landlord seeks: • Rubbish removal $905.00 • Cleaning $991.24 • General repairs $1,437.50 • Insurance excess — methamphetamine claim $800.00 • Insurance excess — loss of rent $250.00 • Filing fee $28.00 Relevant law
At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
Under section 40 of the Residential Tenancies Act 1986, a tenant must keep the premises reasonably clean and tidy, notify the landlord of damage, and leave the premises reasonably clean and tidy at the end of the tenancy. The tenant must also remove all goods and rubbish and return all keys or security devices.
A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
The landlord bears the onus of proving the claim on the balance of probabilities.
The Tribunal may order compensation where loss is proved and where the amount claimed is reasonably incurred and supported by evidence. 5440834 3 The landlord’s claims Cleaning and rubbish removal
I accept the landlord’s evidence that the property was not left in a reasonably clean and tidy condition. The landlord provided an end of tenancy inspection report, photographs and invoices. That evidence showed that personal items and furniture were left throughout the house and section, rubbish was left under the house, and no meaningful cleaning appeared to have been completed.
The carpets and floors required cleaning throughout. There were also cleaning issues involving light shades, windowsills, window frames, curtains, walls, and removal of stickers from a large window. The lawns had not been mowed.
I find the cleaning and rubbish removal costs were reasonably incurred and proved. General repairs
The landlord’s evidence showed holes in walls and doors, missing or removed smoke alarms, curtains needing to be re-hooked, lightbulbs needing replacement, pins needing removal from walls, and other reinstatement work required at the end of the tenancy.
The tenant did not attend to dispute the landlord’s evidence or provide any alternative explanation. I accept the landlord’s evidence that the damage and reinstatement work went beyond fair wear and tear. The invoice and photographs support the amount claimed.
I find the claim for general repairs is proved. Methamphetamine contamination and insurance excess
The landlord produced a pre-tenancy methamphetamine report showing negligible levels before the tenancy began. The landlord also produced a post- tenancy report showing levels significantly above the relevant guidelines.
On the evidence before me, I am satisfied the contamination occurred during the tenancy. The landlord has not claimed the full remediation cost, but only the insurance excess of $800.00 and the insurance excess for loss of rent of $250.00.
I find those amounts are reasonably connected to the tenant’s breach and are proved. 5440834 4 Filing fee
As the landlord has wholly succeeded with the claim, I must order the tenant to reimburse the filing fee.
