Order
- The tenancy of Quoc Duong Doan and Ngon Man Dinh at 172 Queen Street, Pukekohe, Pukekohe 2120 is terminated, and possession is granted to Nitinkumar Rathod, immediately.
- The landlord may retain the tenants’ bond of $2,720.0.
- Quoc Duong Doan and Ngon Man Dinh must pay Nitinkumar Rathod $185.47 immediately, calculated as shown below:
Reasons
- The landlord the hearing which was held by videoconference. The tenants did not attend and could not be contacted on the numbers given in the Notice of Hearing, which was properly served. The landlord understands the tenants may be in prison or deported. Termination
- The tenancy was for a fixed term form 10 October 2025 to 30 October 2026.
- The evidence shows that the premises were not used by the tenants as their residence but for the purpose of cultivating cannabis. The tenants were arrested and imprisoned.
- For that reason and because the rent is more than 21 days in arrears the tenancy is terminated.
How much rent is owed?
- The landlord had provided rent records showing the rent owed to the date of the hearing. Because this is a fixed term tenancy and there is no prospect of the premises being re-tenanted before then, it is fair to calculate the arrears through to the end of the rent week.
- The landlord has also provided records showing the water rates owed.
- The landlord has not lodged the tenants’ bond with the Bond Centre. He now clearly understands his legal obligation to do so. The landlord can keep the bond to offsets the arrears owed.
- Because Nitinkumar Rathod has succeeded with the claim I must reimburse the filing fee.
