Reasons

The landlord attended the hearing, set down to be conducted via video conference. There was no entry into the conference by the tenant, nor any call in to the conference by one of the telephone numbers provided on the Notice of Hearing. I was satisfied adequate service had completed and I continued with the hearing.
The landlord has applied for termination of the tenancy, rent arrears, water rates and refund of the bond.
Unknown, the tenants were waiting to be joined. They contacted the Registry and then entered the conference some 50 minutes late. I joined the landlord and reopened the hearing. The landlord was to provide the tenants with the updated rent summary. The tenants were given until midday 21 April 2026 to provide with any supporting evidence that would reduce the rent arrears, especially if any reduction reduced arrears to less than 21 days.
I have reviewed the additional tenant banking evidence and the landlord’s revised rent summary. The rent summary reflects the ongoing challenge for the tenants in paying what is a large amount of rent weekly.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
The landlord provided rent records which prove the amount owing at the end of the tenancy is as ordered. Any application of water rates from payments received do not alter the significant rent arrears.
The landlord provided the first three water rates invoices for 2026. These total $365.14 after non-consumption costs are removed. This total is awarded. Filing fee
