- The landlord’s representatives attended the hearing held remotely today. The tenants did not attend. I attempted to contact them by telephone, but the numbers went to voicemail. I continued in their absence as email notices and text reminders have been sent.
- The landlord has applied for termination of the tenancy and payment of rent and water arrears.
- The landlord provided rent records which prove the rent is significantly more than 21 days in arrears on the hearing date. The law says the Tribunal must make either a final or conditional termination order. See section 55(1)(a) and s56(2) Residential Tenancies Act 1986.
- The landlord provided email communication from the tenants which says they have moved out. The landlord does not know when the property was vacated. The last time the landlord went to the property (they are not sure of the date), one of the tenants was still there.
- The tenancy is terminated immediately on the grounds of rent arrears.
- I award the amount owing for rent up to today.
- The landlord supplied water invoices and records proving there is $658.45 owing. I award this amount.
- The landlord’s claim is successful so I must also award the filing fee.
- The landlord requests that the bond remain at the Bond Centre in case further cleaning and other costs are incurred.
