The tenancy of [The tenant/s] at Unit/Flat Flat 1, 101 Waitaha Road, Welcome Bay, Tauranga 3112 is terminated, and possession is granted to Accessible Properties New Zealand Limited, at 11:59pm on Sunday 24 May 2026.
[The tenant/s] must pay Accessible Properties New Zealand Limited $1,945.38 calculated below.

[The tenant/s] must pay weekly rent of $90.00 as follows: a. for the rent due on Monday 27 April 2026, not later than 29 April 2026; b. on Monday 4, 11 and 18 May 2026.
If the tenant fails to pay weekly rent within 1 working day of the due dates in Order 4, the tenancy at Unit/Flat Flat 1, 101 Waitaha Road, Welcome Bay, Tauranga 3112 will terminate and the landlord will have immediate possession of the premises.

Reasons

Both parties attended the hearing.
The landlord has applied for termination of the tenancy, rent arrears, compensation and refund of the bond.
The tenant does not dispute the amount of rent arrears claimed. She agrees that she is responsible for the other charges, except for replacement of the fire alarm. The landlord withdraws that claim.
The tenant says that her financial circumstances changed when her children were no longer in her care. She says that changed her benefit entitlements and that she has been struggling since then to have those entitlements and payment of her rent sorted through Work and Income.
She says she has an appointment with Work and Income to work it all out next week.

Should the tenancy be terminated?

Apart from one lump sum payment of $552.00 made by Work and Income on 25 February 2026, no rent has been paid since 30 December 2025.
With the rent being so far in arrears, there is no question that the landlord is entitled to an Order terminating the tenancy. 1
The landlord confirms that if the tenant is able to pay all that is owed, there is otherwise no objection from the landlord’s point of view, to the tenancy continuing.
With the parties’ agreement, I therefore: a. make an Order terminating the tenancy; b. defer termination for 4 weeks to give the tenant a chance to see if she can arrange for what is owed to be paid and discuss with the landlord continuation of the tenancy (which is up to the landlord); c. to protect the landlord against rent arears increasing in the meantime, require that current rent be paid when due until termination date, or the tenancy will immediately end. 1 S.55(1)(a) RTA
The landlord provided rent and water rates records and payment invoices which prove the amount owing.
Because Accessible Properties New Zealand Limited has succeeded with the claim I must reimburse the filing fee.
