This application was scheduled to be heard by video conference. The tenant did not connect to the Teams link provided and nor did she ring in to the hearing as directed by the Notice of Hearing sent to her. My call to the telephone number provided for her also went unanswered. The hearing proceeded in her absence.

The landlord has applied for rent arrears, compensation and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent?

The tenancy ended on 13 January 2026. At that date $3,800.00 was owing in rent arrears. The $2,800.00 bond was applied to that debt and so the tenant now owes $1,000.00 in rent arrears.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.

The photographs show that the tenant did not leave the premises in a reasonably clean condition. However, the photographs provided of the interior do not warrant the cleaning charge $448.50 and I have reduced the amount that the tenant is to pay to $200.00.

The photographs of the exterior show rubbish left outside, green waste distributed on the garden which needed to be removed and garden work needing to be done. The tenant is required to pay the invoiced cost of $385.00 to remedy these issues.

Further, the photographs show several stains on the carpet which were caused during the tenancy. The tenant is therefore required t pay the cost of stain removal, invoiced at $220.00.

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.

Tenants are liable for the cost of repairing damage that is intentional or which results from any activity at the premises that is an imprisonable offence. This applies to anything the tenant does and anything done by a person they are responsible for. See section 49B(1) RTA.

Damage is intentional where a person intends to cause damage and takes the necessary steps to achieve that purpose. Damage is also intentional where a person does something, or allows a situation to continue, knowing that damage is a certainty. See Guo v Korck [2019] NZHC 1541.

The photographs show that 6 doors were damaged and the vanity was detached during the tenancy. This is beyond fair wear and tear and so the tenant is required to pay the invoiced cost of remedying these issues – invoiced at $2,208.00. Filing fee reimbursement

The landlord was substantially successful with the claim made against the tenant and so the tenant is required to reimburse the filing fee to the landlord. Suppression of tenant’s name

Section 95A of the Residential Tenancies Act 1986 provides that: (1) The Tribunal may, on the application of any party to the proceedings or on its own initiative, having regard to the interests of the parties and to the public interest order that all or part of the evidence given or the name or any identifying particulars of any witness or party not be published.

On my own initiative, I am ordering suppression of the tenant’s name. This is because I understand from the landlord that she was the victim of family harm during this tenancy and that her partner was the perpetrator of all the damages.

I therefore do not consider it fair to the tenant that her name is published.

Nor is there any public interest in having the tenant’s name published.
