Reasons
- Mr Dawson for the landlord attended the hearing remotely by video. Neither tenant attended the hearing by the telephone or video links provided in the notice of hearing. I called both tenants on the phone numbers recorded in the application, but the calls went to voice mail.
- The landlord has applied for termination of the tenancy, rent arrears, water rates, compensation and refund of the bond.
- The tenancy was a fixed term tenancy from 13 December 2024 to 31 January 2026. The fixed term was extended from 1 February 2026 to 31 January 2027.
Should the tenancy be terminated?
- Section 55(1)(a) of the Residential Tenancies Act 1986 (RTA) stated that the Tribunal shall make an order terminating the tenancy if the tribunal is satisfied that the rent was, at the date on which the application was filed, at least 21 days in arrears.
- The landlord’s rent summary established that the rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated.
How much rent and water rates are owed?
- The landlord provided rent records which prove the amount owing at the end of the tenancy.
- The landlord has supplied copies of the water rates invoices from Watercare and a tenancy ledger which establishes the tenants owe the water rates claimed.
Are the tenants liable for the Trade Me advertising costs?
- The tenants originally advised the landlord that they did not want the tenancy to continue past the end of the original fixed term. On 6 December 2025 they asked if was too late to change their mind. The landlord agreed but in doing so explained that the landlord had already incurred the cost of advertising the property on Trade Me in reliance on their earlier confirmation.
- I find the granting of the second fixed term by the landlord was conditional on the tenants paying the cost of the Trade Me advertisement. I find this is reasonable in the circumstances. Filing Fee Reimbursement
- As the landlord has wholly succeeded with the claim I must reimburse the filing fee.
