Order
- Mo5 Properties Limited is granted possession of the premises at Unit/Flat Unit 209, 2A Oakley Avenue, Waterview, Auckland 1026 immediately.
- Iqra Naveed to pay Mo5 Properties Limited $1,814.30 from the bond, calculated as shown in table below.
- The Bond Centre is to pay the bond of $2,160.00 immediately apportioned as shown in table below.
Reasons
- The landlord attended the hearing. The tenant did not attend.
- The absence of a party does not prevent the matter from being heard and determined.
- The landlord has applied for possession of the premises following the termination of the tenancy, rent arrears, compensation, refund of the bond, and filing fee.
Is the landlord entitled to possession?
- This was a fixed term tenancy which commenced on 8 November 2025 and was due to run until 7 November 2026.
- The landlord agreed to release the tenant from the tenancy agreement early, so the tenancy ended on 10 April 2026 by agreement. The requirements of section 64(1) of the Residential Tenancies Act 1986 are satisfied and the landlord is entitled to immediate possession as requested. How much is owed for rent, utilities, packing up the tenant’s goods, and cleaning?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
- The tenancy ended on 10 April 2026. The landlord provided rent records and invoices for water, power and internet which prove the amount owing at the end of the tenancy.
- I am satisfied that the tenant asked the landlord to pack and store her clothes/belongings and keep for her until she can collect them. The amount claimed by the landlord to do this, and to clean the premises, is fair and reasonable.
- The tenant did not return the keys
- The tenant’s furniture remains at the premises therefore the landlord must follow the procedure set out in sections 62 and 62A of the Residential Tenancies Act 1986.
- As the landlord has wholly succeeded with the claim, the tenant must reimburse the filing fee.
