The landlord claimed that the following damage was caused during the tenancy: (a)Damage to the carpet in bedroom three. The landlord provided entry and exit inspection photographs which proved that extensive staining to the bedroom three carpet occurred during the tenancy. The landlord sought to remedy this with a carpet clean which was unsuccessful and replacement was required. The landlord is seeking reimbursement of $125.00 for the cost of the carpet clean plus the insurance excess of $450.00 for the replacement. The landlord provided entry and exit photographs and evidence of the costs claimed. I am satisfied that the damage is more than fair wear and tear and was carelessly caused. As the tenant liability is limited to the lesser of the insurance excess or four weeks rent the maximum, I can order in respect of this damage is the insurance excess of $450.00 and this amount is ordered. (b)Damage to kitchen cupboards The landlord claimed that there was extensive pinhole damage to the kitchen cupboards above the fridge and provided entry and exit photographs together with evidence of the cost of the repair in the sum of $287.50. I am satisfied that this damage occurred during the tenancy and is beyond fair wear and tear. The amount sought is less than the insurance excess and is ordered as sought. (c)Damage to paintwork in lounge and hallway The landlord claimed that there was damage to walls in the lounge and hallway beyond fair wear and tear and provided entry and exit photographs. The entry report refers to existing damage on the walls but the landlord advised this was remedied after the entry inspection report was done and provided an invoice for paint touch up work done in January 2025. I have carefully considered the photographs and find that some of the wall damage marks are consistent with fair wear and tear but some marks in particular the larger chip to a corner edge and the marks where the paint has torn off are beyond fair wear and tear. I order the tenants to pay half of the cost of the painting totalling $250.00.
Because Grenadier Rent Shop Limited As The Agent For A & J Bringans has substantially succeeded with the claim I have reimbursed the filing fee.
