The property manager attended the hearing on behalf of the owner. There was no appearance for the tenant.

The landlord has applied for rent arrears, compensation, and and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent?

The tenancy was terminated by the Tribunal on 30 January 2026 and rent arrears ordered to that date along with the refund of the bond.

The tenants did not move out until 11 February 2026 and so further rent arrears are owed. The landlord provided a rent summary which showed that after the bond had been deducted, the rent arrears to 11 February come to $8,921.43. That amount is ordered.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy and remove all rubbish. See section 40(1)(e).

The photos submitted by the landlord show that tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish. Dirty dishes were left in the kitchen.

The landlord submitted an invoice of $180 for initial cleaning. This included removal of food items and to eliminate the smell.

There is a second invoice for $2840 which includes cleaning, carpet cleaning, rubbish removal, skip bin hire drain clearance, gardening, waterblast paths and clearing a blocked drain. The waterblasting was necessary because of oil stains left by the tenant. The blocked drain was on an upstairs balcony, on which leaves had accumulated. The tenants had left a significant amount of rubbish and abandoned items. The photos show grubby carpets.

The amount of $2840 is largely cleaning and rubbish removal. The invoice also included some repairs to an internal glass door and to fix holes in the wall. For the reasons above, and as discussed below, I am satisfied that the tenant should pay this invoice. The amount is ordered.

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.

Where the damage is caused carelessly, and is covered by the landlord's insurance, the tenant's liability is limited to the lesser of the insurance excess or four weeks' rent (or four weeks' market rent in the case of a tenant paying income-related rent). See section 49B(3)(a) RTA.

Where the damage is careless and is not covered by the landlord's insurance, the tenant's liability is limited to four weeks' rent (or market rent). See section 49B(3)(b) RTA. Where insurance money is irrecoverable because of the tenant's conduct, the property is treated as if it is not insured against the damage. See section 49B(3A)(a) RTA.

Tenants are liable for the cost of repairing damage that is intentional or which results from any activity at the premises that is an imprisonable offence. This applies to anything the tenant does and anything done by a person they are responsible for. See section 49B(1) RTA.

Damage is intentional where a person intends to cause damage and takes the necessary steps to achieve that purpose. Damage is also intentional where a person does something, or allows a situation to continue, knowing that damage is a certainty. See Guo v Korck [2019] NZHC 1541.

I am satisfied that there was damage to the internal glass door and minor wall damage.

The landlord submitted a number of estimates and quotes for work to be done, including replacement carpet, garage remotes and further repairs.

No invoices have been submitted and so the actual loss has not been quantified. I have allowed these claims to be withdrawn.

If the landlord has incurred any costs in this regard, he may reapply providing copies of invoices, insurance claims and other evidence of actual loss incurred.

Because the landlord has been wholly successful in the matter that were not withdrawn, I have ordered reimbursement of the filing fee and name suppression for the landlord.

This order also includes the earlier reimbursement of the filing fee that was ordered in the previous proceedings 5399228.
