Both parties attended the hearing.

The tenant has applied for compensation for the landlord’s inspection carried out on an incorrect date but correct day of the week. The tenant believes the landlord’s email to her about the condition of the property was unacceptable.

The landlord has applied for rent arrears since the previous Tribunal order and for compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy. A. The Tenant’s Application

The landlord sent an inspection notice to the tenant stating that she would inspect the property on Monday, 14 August 2025. On the Monday the landlord arrived at the property and waited in her car after the tenant did not answer the door. The landlord could not get hold of the tenant and so entered the premises and took photos of the condition of the premises. Later, after leaving the premises the landlord was contacted by the tenant stating that the landlord should not have entered the premises because 14 August was a Thursday, not a Monday. The tenant has sought compensation stating that this was an unlawful act by the landlord.

I am satisfied that there was a genuine mistake on the part of the landlord. There was no intention to enter unlawfully. I have considered whether there is evidence that the tenant suffered any financial loss or ongoing stress as a result of this incident. There is insufficient evidence provide by the tenant that the mistaken entry and reference to the state of the premises caused harm. The claim for compensation must be dismissed. A. How much is owed for rent and water rates?

The tenancy ended on 11 January 2026. The landlord provided rent records and water rates invoices which prove the amounts being claimed.

This order is for the rent arrears from the date of the previous Tribunal order to the end of the tenancy and does not include the amount ordered on 9 December 2025.

The tenant does not dispute the amount owed for water usage.

Is the tenant responsible for the damage to the exterior door?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.

The landlord supplied evidence from a neighbour. In the document it described that the tenant’s daughter and her friend tried to enter the premises when the tenant was not home. They damaged the door trying to get in and then when that was unsuccessful, entered through a window.

The tenant stated that she dropped her fourteen year old daughter off at a friend’s place in Thames. She instructed the parent not to let her daughter leave the house unless with the parent. The tenant said she does not know why the parent dropped the girls at the tenancy address. The tenant said she was unaware that the girls had tried to forcefully enter the premises until she returned home.

The tenant’s daughter lived with her mother at the premises. Therefore the daughter had permission to be at the premises unless the mother instructed otherwise. However I prefer the tenant’s evidence, that she withdrew her daughter’s permission to be at the premises when her daughter was staying at the friend’s house and the tenant was not home.

There is insufficient evidence to prove that the tenant’s daughter was at the property, with the tenant’s permission. Therefore the tenant is not liable for any damage done to the door by the daughter. The claim for compensation for the door damage is dismissed. A claim would have to be made against the daughter in a Disputes Tribunal if the landlord required compensation. Filing fee

Because the landlord has been partly successful with the claim the filing fee of $28.00 is ordered to be paid by the tenant. The tenant was not partly successful with her claim.
