At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
The Tenants did not leave the premises in a reasonably clean and tidy condition and failed to remove all rubbish at the end of the tenancy. The Landlord submitted that the property was cleaned by the owners over the course of two full days. Photographs provided in evidence showed filthy kitchen cupboards, a dirty stove, debris on the kitchen floor, red marks on the bathroom walls and shower, a heavily soiled shower door, and items left outside the property. The Landlord also submitted that approximately two trailer loads of rubbish were removed and disposed of. The claim includes the owners' labour and the cost of cleaning materials.
In considering the evidence, I am satisfied that the Tenants did not leave the property in a reasonably clean and tidy condition. The photographs clearly demonstrate that a substantial amount of cleaning was required. While the Landlord did not provide receipts for the cleaning products, I accept that such materials would have been reasonably necessary to restore the property to a reasonably clean and tidy standard.
The Landlord also claimed the cost of repairing missing drawer knobs and scratches to the drawers. However, no evidence was provided regarding the condition of the drawers at the start of the tenancy. I am not satisfied that this part of the claim has been proven so it has been refused.
The amounts for cleaning are proved.
As M & A Young Limited has substantially succeeded with the claim the Tenants shall reimburse the filing fee.
