Reasons

Both parties attended the hearing.
This was a short tenancy of about seven weeks and the landlord provided the house fully furnished. The tenant has claimed compensation because the house was not clean, and the washing machine was only plumbed for hot water and could not be used as expected. The landlord did not agree to pay compensation.
This is the tenant’s claim to prove. I have only been provided with two photos supporting the claim for cleaning. I find this is not enough evidence and the claim is dismissed.
It is agreed evidence the washing machine could only run using hot water. The landlord said she provided a functioning washing machine, and the tenant agreed that they could wash towels and bedding in the hot water. However, they had to go to a friend’s house to do other washing.
This is the tenant’s claim to prove. I have not been provided with any supporting evidence there was an additional cost, or that clothes were ruined. I find it was reasonable for the tenant to expect that the washing machine would also wash clothes using cold water. I find there was a loss of amenity because the tenant and her flat mate could not use the washing machine as they expected, which was a nuisance and amounted to extra work. I find a small amount of compensation is fair and allow $20 a week for six weeks.
Because the tenant has substantially succeeded with the claim I have reimbursed the filing fee.
We did not discuss suppression at the hearing. Section 95A RTA provides that the Tribunal may, on the application of any party to proceedings or on its own initiative, order that the name of a party not be published, having regard to the interests of the parties and to the public interest.
I have used my discretion and allowed suppression for the tenant because she is the most successful party. The landlord’s name will be published because there is public interest when landlords have to pay compensation.
