Reasons

All three tenants failed to make themselves available for the hearing. Service did occur and I attempted to call them individually however they all failed to answer the call.
The absence of the parties does not preclude me from hearing and determining the case when they are the respondents. However, in relation to any claims they may have wished to bring to the tribunal as applicants, their absence results in their applications being dismissed. The applicant landlord was represented.
The landlord has applied for rent arrears, compensation for rubbish removal, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

What was the start and end date for this tenancy and how much is owed for rent?

The applicant gave evidence in relation to the commencement and end date of this tenancy.
The background to this case is that two of these tenants together with others were tenants in the property and that changed around the time this management company took over the management of the property.
The tenancy was to end but the remaining two tenants wished to remain and include the third tenant. It was also at a time that the inspection of the property revealed the condition of the downstairs residence, occupied by two of these tenants as a couple. They remained in the tenancy and a new agreement was signed that included the new third tenant. The tenants already in occupation were given notice to clean up the inside of their living space.
Having considered all the evidence I find that the tenancy with these three tenants commenced in November and ended on 16 February 2026.
In relation to the rent arrears, the landlord provided rent records which prove the amount owing at the end of the tenancy. There were no arrears when the third tenant joined the tenancy. The amounts ordered are proven.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
The tenants certainly did not leave the premises reasonably clean and tidy, and did not remove all rubbish.
The photo evidence is concerning and replicates hording type behaviour. The outside of the property was strewn with furniture rubbish and belongings.
There was a carpet bug infestation and, in several rooms, it appeared that the cat had been locked inside and cat faeces covered the floors. The smell I am told was horrendous.
The property was subject to a Council complaint and the tenants were issued a notice and subsequently were given ample notice to clean up the property, but this did not occur.
Whilst it appears that the third tenant that joined the tenancy left before the remaining two, her obligations under the Residential Tenancies Act were not carried out in relation to notice. (amongst other breaches).
The landlord had accepted a termination of the fixed term tenancy but ultimately the landlord was not notified when the tenants actually vacated. The property manager visited the property to find that it had appeared as though the tenants had abandoned the property. This application was subsequently made.
The freezer had been left with food rotting as there was no power.
Given the condition of the property the landlord would have been within their rights to file for further costs. However, they have not done so, taking on board the fact that they intended to upgrade the carpet and repaint in any event. The costs claimed are in relation to rubbish removal, clean up costs if claimed would have been significant.
All tenants are jointly and severely liable for all costs associated with a tenancy and while the two other tenants had been warned of the clean-up required to the main area they occupied downstairs, the remaining cleaning at the time all three ended the tenancy was far worse and included more than their room.
Having considered all the evidence I find that the three tenants named are responsible for the clean up costs at the end of this tenancy.
The tenant’s argument that they submitted to the Tribunal that there was no pre inspection and the rubbish was the previous tenants is simply not accepted. The two tenants that remained were aware of the concerns regarding the condition of the inside of the property. The outside was not in the condition it was when the third tenant entered the tenancy. The clean up required was not limited to the two tenants living area that were in occupation for the previous tenancy.
The condition that the property was left in was the worst the property manager had encountered. She was extremely concerned for the tenant’s health whilst they remained in the tenancy and did everything to try and assist them. I am told that a 14 day notice to remedy would not have been enough time to remedy the mess that the home was in. The property manager advises that she has since received abuse and negative reviews made public.
Whilst at the time of signing the new tenant, the tenants that remained were given the opportunity to clean up their downstairs area. It was however in a worst condition, together with other rooms and the outside, when the property was revisited at the end of this tenancy.
I am satisfied having considered all of the evidence that these three tenants are liable for the rubbish removal costs as sought.
Because [The landlord/s] And Portfolio Management Limited As The Agent For Rabeeb Saeid has wholly succeeded with the claim I must reimburse the filing fee.
