Reasons

This application was scheduled to be heard by video conference. The tenant did not connect to the Teams link provided to him and nor did he ring in to the hearing as directed in the Notice of Hearing. My call to the telephone number provided for him went straight to voicemail. The hearing therefore proceeded in his absence.
The landlord has applied for rent arrears and compensation following the end of the tenancy.

How much is owed for rent?

The tenancy ended on 2 February 2026. The landlord provided rent records which prove the amount owing at the end of the tenancy - $208.78. This amount includes payment of the bond of $230.00 towards the arrears which were originally $438.78.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The photographs show that there was a large amount of green waste left at the property and a small amount of rubbish left inside the house.
As discussed at today’s hearing I have reduced the amount claimed from $195.11 to $175.11 because I considered the amount asked for clearing the inside was not reasonable.

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
I accept the evidence which shows that during the tenancy the tenant attempted to patch a hole in bedroom 1 wall and the entry hall wall. These patches were not done to a satisfactory standard and so the tenant is required to pay the cost of remedying this.
I also accept the evidence showing that there was a large dent in the lounge wall which occurred during the tenancy. The damage is more than fair wear and tear.
The amount ordered to remedy these issues is proved.
I note that at today’s hearing the landlord withdrew the claim regarding the carpet in bedroom 1. C ter Haar 08 July 2026
