The property was let to these tenants soon after purchase and had not been occupied by anyone else in between.

The landlord submitted an invoice for $1078.70 including carpet cleaning. That amount is ordered.

The lawns were very overgrown. The landlord submitted an invoice for lawns and gardens. He sought only the cost of the lawnmowing and provided a screenshot of a text confirming that the lawnmowing was $150 including GST.

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.

The landlord provided photographs of the curtains at the end of the tenancy. Some were torn, and some soiled. I accept that they needed replacement.

I have taken into account betterment and depreciation. The landlord should be returned to the position they would have been in had the tenant not breached their obligations, and should not be better or worse off. In calculating depreciation, I have taken into account the age and condition of the items at the start of the tenancy and their likely useful lifespan.

The curtains were not new at the start of the tenancy and based on the photos even when the property was marketed, appear to be several years old. However, they would not have needed replacement if they had been treated properly during the tenancy. The tenants are ordered to contribute $700.00 to the replacement cost.

The landlord submitted an invoice for $218.50 in relation to a ceiling fan. At the end of the tenancy it was not working. The invoice is for having it removed and replaced with a light instead. The landlord was unsure how it was damaged, but the photo of the remote control showed clear damage with buttons missing. The tenant has not reported to the landlord that it had stopped working.

There was considerable damage throughout the property with multiple holes that had been patched and wallpaper ripped off.

Given the state of the property and the fact that the tenant had not reported that the fan had stopped working, I have drawn the inference that the tenant caused the damage. I order $218.50.

The amounts ordered are proved.

The landlord submitted a quote for painting the interior of the house. The work has not been done. Some minor repairs have been done to tidy the property up and it is now rented out.

I have allowed the landlord to withdraw that claim. If the work is done, then they may be able to bring a further claim. That needs to happen withing 6 years of the end of the tenancy. They will also need to be clear what if any liability any future tenants may have.

Because [The applicant/s] has substantially succeeded with the claim I have reimbursed the filing fee and I order name suppression.
