Under section 39(3) of the Residential tenancies Act 1986 (the “Act”), tenants are responsible for all outgoing in respect of the premises that are exclusively attributable to the tenant’s occupation of the premises and use of the facilities. Section 39(4)(c) of the Act specifically states tenants are responsible for charges for water consumption.

The parties agree that over the course of the tenancy two water leaks were identified. The first water leak was identified in January 2026 following a significant water rates bill. Due to difficulties locating the water meter the leak was not repaired immediately, but resolved during a return visit by the plumber. The second water leak was discovered in February 2026 and was successfully resolved after leaks in the kitchen and toilet were repaired.

The landlord said the amount of water rates claimed has been reduced to reflect impact of the leaks on the water bills. Water rates bills were provided for the whole of the tenancy. The bills were significant and show Watercare crediting $1,159.30 to the water account for the January 2026 leak.

The landlord’s records reflect the tenant only paid $21.00 in water rates during the tenancy.

The tenant told the Tribunal that she takes no issue with the amount of water rates claimed by the landlord. The Tribunal heard that over the course of the tenancy the tenant lived at the property with her adult daughter and teenage son. The tenant said she also had her two adult sons living with her up to February 2026.

The Tribunal accepts the parties have agreed the amount owed in water rates. The Tribunal has adjusted that figure to reflect the amount claimed in the tenancy invoices document. Given the agreement between the parties, the amount of $400.00 is ordered. Other matters

The Tribunal orders the bond be refund in full to the landlord to offset a portion of the rent and water rates debt.

Because New Age Rentals Limited As Agent For Rishi Kochhar has wholly succeeded with the claim I must reimburse the filing fee.

The parties did not seek name suppression.
