There was no entry into the conference by the tenant, nor any call in to the conference by one of the telephone numbers provided on the Notice of Hearing. I was satisfied adequate service had completed and I continued with the hearing.
The landlord has applied for rent arrears, compensation, and refund of the bond, following the end of the tenancy.

How much is owed for rent?

The tenancy of almost 18 years ended on 6 November 2025. The tenant was transferred into another premises of this landlord. The landlord provided a rent summary that proves the amount owing at the end of the tenancy is as ordered. The final rent arrears as ordered is a reduced total after a series of $10.00 weekly payment post-tenancy were made by the tenant. These payments stopped after 1 April 2026.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The tenant did not remove all rubbish. The landlord had submitted a claim based on green waste and 19m 3 of external rubbish. The landlord revised this claim significantly downwards just before the hearing on the basis that the evidence for such a volume did not exist. I concur. The revised claim of $519.15 aligns with the items and rubbish left behind and this is awarded.

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
Where the damage is caused carelessly, and is covered by the landlord's insurance, the tenant's liability is limited to the lesser of the insurance excess or four weeks' rent (or four weeks' market rent in the case of a tenant paying income-related rent). See section 49B(3)(a) RTA.
Where the damage is careless and is not covered by the landlord's insurance, the tenant's liability is limited to four weeks' rent (or market rent). See section 49B(3)(b) RTA. Where insurance money is irrecoverable because of the tenant's conduct, the property is treated as if it is not insured against the damage. See section 49B(3A)(a) RTA.
The following damage was caused during the tenancy: a. 17 holes in various walls and one hole in a door. The exit photos show extensive wall damage in the living room, hallway and three bedrooms. These holes required patching. The invoiced cost of these repairs was $876.22, and this is awarded. b. Wall lining replacement. A number of walls were solid-board. They could not be spot repaired. Replacement of sheets of wall lining board were required in the dining room, toilet and laundry. The exit photos prove the damage, and the invoice establishes the cost of repair as $630.66. This sum is awarded. c. Laundry door jam. The laundry door jam was shattered. The cost of repair was $237.48. A photo was provided that showed the need for the repair.
The damage is more than fair wear and tear, and the tenant has not disproved liability for the damage.
