- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
- Rent was at least 21 days in arrears on the date the application was filed. The rent arrears have increased to over $2000.00. The landlord advised that the tenant is not living at the premises and has not communicated with them about the rent arrears.
- The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986 which states that the Tribunal shall make an order terminating the tenancy if the rent is more than 21 days in arrears at the time of application.
- The landlord provided rent records which prove the amount owing at the date of application and at the end of the tenancy.
- Because Accessible Properties New Zealand Limited has wholly succeeded with the claim I must reimburse the filing fee.
