The landlords advised that the landlord could advertise and find a new tenant to take over the tenancy, but that the tenants would be responsible for an early termination fee, advertising and rent until the initiation of a new tenancy.

On 12 March 2026 the tenants confirmed by email that they were happy to go with this option.

The tenants then vacated the property on 29 March 2026.

The landlord advised that a new tenancy commenced on 11 June 2026 and accordingly they claim rent until 10 June 2026 together with the break lease fee of $759.00 and advertising of $230.00. Rent records were provided proving the outstanding amount of $9,333.71 through to 10 June 2026.

These costs appear reasonable and in accordance with section 44A of the Residential Tenancies Act 1986 (RTA) and were only incurred as a result of the landlord agreeing to allow the tenant to end the fixed term tenancy early.

The landlord also claims for water rates of $633.71 for water to 10 June 2026.

However, the tenants vacated the property on 29 March 2026 and are only responsible for water usage, not for any fixed charges. 1 I have therefore reduced the amount awarded to roughly this date instead. 2

On review of the evidence, I am satisfied that the tenants did not meet the statutory standard and the amount ordered is proved.
