Reasons
- Both parties attended the hearing. The Property Management Company was represented by Ms Yin who was assisted by an interpreter at her request.
- The landlord has applied for termination of the tenancy, rent arrears, water rates arrears and refund of the bond.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent records which prove the amount owing at the end of the tenancy. The tenant accepted the arrears and stated she simply could no longer afford the costs and had attempted to seek assistance without success.
- Ms Yin agreed for the termination to occur on Sunday to allow the tenant to clean up and vacate the property.
- The rent arrears are taken up to that date. It is noted that the water rates figure is not updated. If the landlord is required to bring a further application for clean- up costs and or damages it would be expected that the updated water rates would also be sought. However, for the purposes of todays hearing there was agreement to record the water rates as known at todays date.
- Because Home365 Property Management Limited As Agent For Gaia Pj2 Limited has wholly succeeded with the claim I must reimburse the filing fee.
