How much is owed for rent and water rates?

This was a fixed term tenancy due to end on 10 September 2026.

The tenant asked to be released from the fixed term tenancy and moved out of the premises on 30 March 2026.

The landlord agreed to end the tenancy early and secured a new tenant with that tenancy commencing on 9 May 2026.

The tenant agreed to pay the break lease costs due to the early ending of the tenancy. The break lease costs of $915.00 are awarded.

The tenant is liable for rent up to either the day before a new tenancy or the end of the fixed term. As a new tenancy started on 9 May 2026 the tenant is liable for rent to 8 May 2026.

The landlord had reduced rent by $100.00 for one week at the beginning of the tenancy due to earth works carried out to install a retaining wall and drainage. While the earthworks may have been completed around 18 September 2025 the complete outdoor space, which had previously been lawn, was muddy.

The photographs produced show that the tenant would have been unable to use the outdoor space as she had intended given that she had a toddler and a dog.

The landlord produced a routine inspection report dated 4 December 2025 showing that the grass had begun to grow. There is no evidence prior to that date that shows that the lawn area was fully useable.

The property management company had given the tenant $50.00 a week over four weeks. The tenant has received a total of $300.00 for inconvenience caused by the excavation to the outdoor area. I do not consider that that is sufficient given the evidence produced.

I have awarded the tenant compensation of $900.00 which is $100.00 a week for the 12 weeks from the start of the tenancy to 4 December 2025, less the $300.00 that the tenant had received.

The landlord provided rent records and water rates invoices which prove the amount owing at the end of the tenancy.

The landlord claimed $2,057.60 for painting walls at the end of the tenancy. The landlord produced photographs, but they did not clearly show the damage, and they were not labelled so it was not clear which photograph was of which wall in the different rooms. The landlord said that there was wall damage in the lounge, kitchen, hallway and all the bedrooms.

The tenant said that she had put sticky hooks in the kitchen to the right of the rangehood. This is one of the areas claimed by the landlord. The tenant said that she painted the walls where the hooks had taken some paint when they were removed. She denied any other marks or painting anywhere else in the premises.

Given the lack of clear evidence I cannot award the landlord for the full cost of painting because it is not clear that the tenant caused the damage or that the damage was more than fair wear and tear. I award $200.00 for the damage that the tenant has acknowledged occurred in the kitchen by the rangehood.

The tenant had applied to be released from the fixed term. The tenant said that the change of circumstances was the passing of her grandmother and the need for her to move home to be by her mother. It is not clear that this change of circumstances required the tenant to move. The tenant’s claim to be released from the fixed term is dismissed.

As both parties had some success with their applications I make no award for reimbursement of the filing fee. For the same reason I suppress both parties names are suppressed as sought.
