The landlord and both tenants attended the hearing held remotely today.

The landlord has applied for termination of the tenancy, rent and water arrears and refund of the bond.

The landlord provided rent records which prove that rent was at least 21 days in arrears at the date the application was filed and that another week of rent was missed after that date.

The law says the Tribunal must make either a final or conditional termination order when rent is at least 21 days in arrears on the date the application was filed or on the hearing date. Section 55(1)(a) Residential Tenancies Act 1986 (RTA).

The landlord also provided water rates records. The ledger shows the total amount invoiced by Watercare up to the May 2026 bill is $2,136.58. The tenants accept they have not made any payments towards water usage during the tenancy.

A landlord must pay the fixed water charges (because these are charged whether or not the premises are tenanted); section 39(1)(a) RTA.

I calculate the fixed charges to be $363.91 and deduct this from the amount invoiced. 1 The amount owing by the tenants for water usage is $1,772.67.

Both parties raised other concerns. The landlord provided photos taken recently which show several broken windows that have been boarded up or covered with plastic. The tenant accepts this and says a previous occupant was violent.

The landlord is concerned about weathertightness due to the number of broken windows and that screws have been screwed directly into the weatherboard in places. This can allow rain to get into cladding and cause mould and rot. 1 Watercare fixed charges equate to 0.79 cents per day from 17/3/2025 to 30/06/2025 which is $62.41 and 0.90 cents per day from 1/07/2025 to 31/05/2026 which is $301.50.

The landlord also says he has not been able to inspect the premises or contact the tenants on a consistent basis.

The tenant says there have been maintenance issues to do with hot water, a leaking tap, and drainage when it rains. She has not raised the issues with the landlord in writing.

My decision is that the tenancy must be terminated because of the rent and water rates owing and the landlord’s concerns about weathertightness and damage to the property. If either party wants to make claims about their concerns, they should file new applications with evidence.

After discussion in the hearing, it has been agreed that the tenancy will continue until 12 noon on Tuesday 16 June 2026 if the tenants pay weekly rent of $730.00 today. If they do not pay this rent within one working day, the tenancy will terminate immediately.

The total amount owing to the day of the hearing is $2,398.57 for rent and $1,772.67 for water. I award the filing fee and refund the bond to the landlord.

I read in the documents after the hearing, that there were no batteries in the smoke alarm/s at the last inspection. The landlord or tenant should urgently install these to avoid risk to life and property.

The landlord’s claim is successful, so I suppress his name, as sought. There are no grounds to suppress the tenants’ names.
