The tenancy of Fono Sione at 23 Marumaru Lane, Manurewa, Auckland 2102 is terminated, and possession is granted to Opes Property Management North Limited as agent for KDCR Kotuku Limited, at 11:59pm on 22 May 2026.
Fono Sione must pay Opes Property Management North Limited as agent for KDCR Kotuku Limited $2,135.23 from the bond, as calculated in the table below:

The Bond Centre is to pay $2,135.23 from the bond of $2,600.00 (BN- 25100339) to Opes Property Management North Limited as agent for KDCR Kotuku Limited immediately.
The balance of the bond of $464.77 is to remain at the Bond Centre.

Reasons

The landlord attended the hearing. The tenant did not attend, and the hearing proceeded in their absence.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986 (RTA).
The landlord provided rent records which prove the amount owing of $4,521.43 through to 22 May 2026. However, there is a previous Mediator’s Order that includes a portion of this rent, up until 15 April 2026 of $2,785.71 together with the filing fee of $28.00. The landlord advised that enforcement has already commenced on this order, and therefore I am unable to include any claimed amounts from that order within this order.
I have accordingly deducted the rent from the previous awarded ($2,785.71) from the rent awarded in this order.
This leaves a remaining amount of $1,735.72 owing and the amount ordered is proved.
The landlord has also provided water rates record that prove the amount owing of $371.51 through to 17 April 2026.
After directing that the bond be applied to the most recent rent and water arrears, there remains a balance. The Tribunal cannot order that the remaining bond be paid toward the previous Mediator’s Order. The balance of the bond must remain at the Bond Centre until a further lawful claim is made or enforcement of the previous order is completed.
Because Opes Property Management North Limited as agent for KDCR Kotuku Limited has wholly succeeded with the claim I must also reimburse the filing fee. R Harvey-Lane 22 May 2026
