The landlord provided photographic evidence that the following damage was caused during the tenancy: a. The cooktop was cracked. From an examination of the photographic evidence, it appeared as if something heavy had fallen on it. This was careless damage. b. There was a large hole in the lounge door, together with holes in the walls behind the door. From their size and nature, this damage was intentional. c. There were multiple deep scratches on the internal laundry door which appeared to have been caused by a dog’s claws. It is reasonable to conclude that this damage occurred over a period of time and not from one event. It was therefore intentional damage. d. The screen door’s mesh had been badly damaged and the door was ripped off its top hinge. This appears to have been intentional damage. e. The door to bedroom 1 and its walls were extensively damaged with holes and gouge marks. From its scale and nature, this damage was intentional. f. The tiles in front of the fireplace were cracked and broken. This damage does not appear to have happened in one event and therefore appears to have been intentional. g. The carpet was extensively stained and was in significantly worse condition at the end of the tenancy than at the start. The landlord gave evidence that the carpet was damaged beyond repair by cat urine and staining, and that the landlord’s insurance company agreed to replace the carpet as it was beyond repair.
The damage is more than fair wear and tear, and the tenant has not disproved liability for the damage.
Despite the Tribunal’s determination that almost all of the damage was intentional, the landlord has claimed only its insurance excesses for each of the listed areas of damage. The tenant would otherwise have been liable for the full costs for any of the intentional damage. Because the amount awarded for each area of damage is only $750.00, it is not appropriate to reduce the amounts awarded for depreciation or betterment.
