Reasons

Both parties attended the hearing via remote telephone conference. The court appointed Mandarin interpreter attended for the landlord. She was not required and was released.
The landlord has applied for termination of the tenancy, rent and water arrears and refund of the bond.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
The landlord provided rent and water records which prove the amounts owing at the hearing date. Having sighted the landlord’s rent and water evidence I am satisfied that the tenant is responsible for the debt.
The claim for outstanding rent and water charges is proven.
Because Shelter Realty Limited As Agent For Sarabjit Singh has wholly succeeded with the claim I must reimburse the filing fee. Name suppression
The tenant in this case is not automatically entitled to name suppression.
During the hearing I heard from the tenant in respect of her employment and family situation. There are 3 young children involved who also reside at the property. Notwithstanding the breach of tenant obligations in respect of rent, the rent ledger suggests genuine attempts by the tenant to meet her obligations.
In cases involving rent arrears, name suppression is not automatic for tenants who have not substantially succeeded. However, the Tribunal may consider the impact of publication on innocent third parties, such as children residing at the premises.
If publication of the tenant’s name would unfairly penalise the children, who are not responsible for the arrears and may suffer harm or stigma as a result, this is a relevant factor in assessing the interests of justice.
While the primary focus is on the conduct of the parties, the Tribunal can take into account the welfare of children and the potential for collateral harm.
I am satisfied that publication would disproportionately affect the children, and that suppression would not undermine the public interest in open justice
I find that it is open to the Tribunal to order name suppression under section 95A(4) in this situation.
Accordingly, I have decided to exercise my discretion to grant name suppression to the tenant (section 95A(4) of the Act).
