If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission.
The carpet needed replacing at the end of the tenancy due to soiling from a pet. There was an attempt to clean the carpet, but this was unsuccessful, and the landlord was advised to uplift and replace the carpet and underlay. Pest control was also required for the same reason. There was damage to some of the walls and cupboard doors were missing. The damage is more than fair wear and tear, and the tenant has not disproved liability for the damage.
I have depreciated the carpet claim by 30% (the amount claimed was $2,482.65). I have not depreciated the painting cost for the walls, as they were newly renovated. Filing Fee
