The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent and water rates?

The tenant gave notice to the terminate the tenancy on or around 13 th September 2022. The tenant was unable to continue paying rent due to his mother passing away.
The tenant physically moved out of the premises at the same time.
The landlord calculated 4 weeks from the notice date and agreed for 11 th October 2023 to be the final date of tenancy.
However, as the landlord was understanding of the tenant’s situation, the landlord offered to take the keys back earlier as the landlord also wanted to re- let the premises as soon as possible and release the tenant from his obligations.
The tenant returned the keys to the landlord on 29 th September 2023.
I find this as the final date of tenancy instead of 11 th October 2023.
The rent owing to 29 th September 2023 was $1,165.00.
The final water arrears was $55.36.
The amounts were not disputed by the tenant.
I order the tenant to pay the amounts accordingly to the landlord.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy and remove all rubbish. See section 40(1)(e) Residential Tenancies Act 1986 (“RTA”).
The tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish.
Even after the key was returned, the landlord offered to give tenant the key back to allow him to do the final cleaning himself.
However, despite the opportunities, the tenant did not manage to leave the premises reasonably clean and tidy. The tenant could not remove all his rubbish by the agreed date.
Having seen the photos and invoices, I order the tenant to pay the landlord $1,817.00 for the final clean up and $276.00 for garden works.
The tenant accepted liability for damaging telephone wall sockets, toilet seating and missing light bulbs.
For those, I order the tenant to pay $50.00 for each item.
The landlord had sought compensation for exterior sensor light and its associated call out and labour costs. Having seen the photo of the sensor light, I find that it was no more than wear and tear. I do not find that there was damage caused by the tenant either carelessly or intentionally.
The landlord also sought compensation for damage done to the kitchen cabinet and wooden frames. The tenant explained that there was a rat in the house and the damage seemed to accord with that explanation.
In relation to replacements of 4 window handles, I find that they were wear and tear also.
Therefore, I do not grant those amounts. Filing fee reimbursement
Because [The applicant/s] has substantially succeeded with the claim, I order the tenant to reimburse the filing fee. Name suppression
As this is a case where the tenant only faced issues after losing his mother who was a co-tenant, I find that there is no public interest in the actual names being made public.
Therefore, the I order the suppression of the names of both parties as well as the address.
