Ms Clark advised that Mr Anderson moved out of the premises before the tenancy ended, however, as both names remain on the tenancy agreement the landlord advised that orders were sought against both parties.
The landlord has applied for rent and water arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
The landlord sought to withdraw the claim for compensation for repairs after considering the evidence filed by the tenant prior to the hearing.

How much is owed for rent and water rates?

This was a fixed term tenancy due to end on 22 July 2023. The tenants sought to end the tenancy early and moved out of the premises on 1 February 2023. The landlord found new tenants to move into the premises and seeks rent to 18 March 2023. The tenant did not dispute this.
The landlord provided rent records which prove the amount owing.
The landlord sought water rates to 18 March 2023 totalling $424.46 and provided water rates invoices. The tenants are only liable for water exclusively attributed to their use of the premises. As the tenants stopped using water at the premises on 1 February 2023 water rates are ordered to that date in the sum of $373.51.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The landlord claimed that the tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish.
The tenant disputed that the premises were not left reasonably clean and tidy. The landlord stated that the cleaning required was for cobwebs and the oven. This does not match the cleaning invoice which records carpet clean, bathroom clean and kitchen. No photographs of cobwebs or the oven were provided. Two exit reports dated the same date are provided, one records the condition of the premises as “acceptable”, the other records “cleaning required”. Having considered the evidence I am not persuaded that the landlord has proved on the balance of probabilities that cleaning was required and this claim is dismissed.
The landlord sought the cost of mowing the lawns twice following the end of the tenancy. I am satisfied that one lawn mowing was required and order the amount of $175.00. The landlord has not provided sufficient evidence that a second lawn mowing was required and this amount is not ordered.
The tenant agreed that rubbish was left at the premises but stated that there were three mattresses that were there from the beginning of the tenancy. The landlord provided invoices for interior and exterior rubbish removal and agreed to a deduction of $75.00 for the three mattresses. The balance of the rubbish removal has been ordered in the sum of $525.05.
The landlord applied for a suppression order but at the hearing sought to withdraw this.
Because Reliance Property Management Limited has substantially succeeded with the claim I have reimbursed the filing fee.
