See section 40(1)(e)(ii) -(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1) (ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.

The tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish.

The landlord provided the Tribunal with an exit report and attached photos of the property at the end of the tenancy, and invoices for the clean-up of the property.

The property was left in a dirty and untidy condition. All the tenants’ possessions and rubbish were left at the house for the landlord to take care of. The lawns were overgrown and exterior and interior of the house were filled with rubbish.

The landlord provided the Tribunal with an invoice from Clean Planet dated 3 April 2023 for $336.83 for cleaning and one from Doug’s maintenance for $1840.00 dated 20 March 2023. Doug’s invoice was for removing rubbish from the house and carport, plus garden waste and old furniture, plus timber under the deck and mowing the lawns.

I am satisfied that the landlord has proven their claims for the two invoices.

The amounts ordered are proved.

The bond is to be refunded to the landlord to offset the debt owed by the tenants to the landlord.

Because Mog Limited T/A Angel Property Managers as Agent for Michelle Miller has wholly succeeded with the claim I must reimburse the filing fee.
