The tenancy ended on 6 June 2023.
The landlord’s application seeks a small amount of rent arrears, cleaning costs, cockroach treatment, and the cost of replacing the heat pump remote.
Both parties attended the hearing in Kaikohe on 15 September 2023. Ms van Engelen represented the landlord.
The landlord’s rent record establishes one day of rent arrears (the last day of the tenancy).
The tenancy agreement note that the heat pump had a remote control at the beginning of the tenancy. The remote control was missing at the end of the tenancy. The amount claimed for replacement is proven.
Tenants must leave the premises reasonably clean and tidy at the end of the tenancy 1 .
The claim seeks $262.50 for cleaning carried out after the tenancy ended.
Ms van Engelen and Mr Walker both provided photographs showing the condition of the premises at the end of the tenancy.
The photographs show that the premises were generally in reasonably clean and tidy condition, but some further cleaning was necessary in respect of the windows and (to a minor extent) the shower and the oven.
I will award $150.00 for cleaning.
Ms van Engelen noted cockroaches present when she carried out the final inspection. She arranged for pest treatment, which was carried out by Northpest. The cost was $350.00.
The presence of cockroaches (or other pests such as rodents) does not necessarily mean that the tenants failed to keep the premises in a reasonably clean and tidy condition.
Pest infestations can be caused by a range of factors, and landlords and tenants share responsibility for pest management.
Ms van Engelen’s evidence shows that pest treatment was justified in this instance. The cost will be shared between landlord and tenant.
The landlord has been partially successful in this application, and I will also award the landlord the filing fee for this application 2 . 1 Section 40(1)(e)(iii) Residential Tenancies Act 1986 (RTA) 2 Section 102(4)(b) RTA
Mid North Real Estate will receive $504.44 from the bond. The balance will be released to Mr Walker.
