Reasons

A hearing was held on 2 May 2024. The landlord attended the hearing, but the tenant did not attend. Service of the hearing notice
This matter was previously filed in November 2022 (application 4453832) but it did not proceed to a hearing.
This is the landlord’s second application. The application was filed more than two months after the end of the tenancy, so the usual service rules no longer apply.
The application must be served either personally on the tenant, on someone over the age of 16 living at address where the tenant now lives, or by post to an address provided by the tenant within two months before the application was made. See section 91A(2) Residential Tenancies Act 1986 (“RTA”).
Section 91B RTA provides if notice of the hearing has not been carried out in accordance with s 91A(2) RTA, and the Tribunal is satisfied that all reasonable efforts have been made to serve the notice, then the Tribunal may dispense with the requirements for service and proceed as if the notice has been served in accordance with the RTA ( see s.91B (2)(c) RTA).
The tenant has been in communication with the landlord by email as recently as 6 October 2023 advising that she now lives overseas. That tenant email address has been used by Tenancy Services to give notice of this hearing. I am satisfied that all reasonable steps have been taken to serve the tenant with notice of these proceedings. I dispense with the requirement for service and proceed as if notice has been given. The landlord has applied for rent arrears, unpaid water rates, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent and water rates?

The tenancy ended on 16 October 2022. The landlord provided rent records and water rates invoices which prove the amount owing at the end of the tenancy.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) RTA.
I am satisfied on the evidence produced by the landlord that the tenant did not leave the premises reasonably clean and tidy.
The landlord relied on photographs of the condition of the premises at the end of the tenancy and invoices. The landlord’s evidence is undisputed.
The amounts ordered are proved. Filing fee and suppression order
As the landlord has wholly succeeded with the claim, I must order the other party to reimburse the filing fee.
The landlord does not seek a suppression order.
It is appropriate to grant suppression of the tenant’s name and identifying details given the sensitive nature of her personal circumstances and to maintain privacy. Such public interest as there may be in this case does not, in my view, outweigh these factors. I have made a suppression order in favour of the tenant.
