Reasons

The tenancy ended in November 2022.
The application seeks rubbish removal and cleaning costs.
The hearing took place in [Event location suppressed] on 2 February 2024.
[The tenant/s] attended the hearing. Ms Daniela represented Kāinga Ora.
[The tenant/s] submitted that: a. He moved from a 6-bedroom house in [town] to this 3-bedroom house in Otangarei, and there was not enough room for his family’s belongings and furniture. b. It was difficult for him and his wife to remove all of their belongings and to tidy up before the end of the tenancy. c. A Kāinga Ora representative told him to take as much as he could and to leave the property ‘as is’ if he ran out of time. d. Kāinga Ora were difficult to communicate with and they failed to address problems with the property, some of which were health and safety issues.
I acknowledge [The tenant/s] concerns.
However: a. All tenants have a legal duty to leave the premises reasonably clean and tidy and to remove all rubbish at the end of a tenancy 1 . b. Kāinga Ora’s comment to him was a purely practical one, made in light of the fact that it was apparent that he would not be able to tidy up in time for the end of the tenancy. It did not amount to a waiver of the tenants’ legal duty, or a waiver of the landlord’s right to recover costs if the tenants failed to leave the premises reasonably clean and tidy and remove all rubbish. c. Kāinga Ora has legal duties as a landlord. If [The tenant/s] considers that Kāinga Ora has not met those legal duties he may bring his own application to the Tenancy Tribunal. The application can be filed online at www.tenancy.govt.nz The filing fee is $20.44. Tenancy Services provides free and impartial assistance to tenants and landlords, including advice and assistance with filing Tenancy Tribunal applications. They can be contacted on 0800 836 262 (0800 TENANCY).
The premises were not left reasonably clean and tidy at the end of the tenancy, and the tenants did not remove all rubbish. The amounts claimed for cleaning and rubbish removal are proven, and are fair and reasonable having regard to the landlord’s photographs.
The landlord has been successful in this application, and I must also award the landlord the filing fee of $20.44 2 .
Although Kāinga Ora’s comment to [The tenant/s] to leave the property as it is if he ran out of time does not amount to a defence to the claim for cleaning and rubbish removal, I accept [The tenant/s] statement that it is not his practice to leave properties in an untidy state. 1 Section 40(1)(e)(iii) Residential Tenancies Act 1986 (RTA) 2 Section 102(4)(a) RTA
In the circumstances it is appropriate to exercise the Tribunal’s discretion to award name suppression 3 .
