Reasons

The landlord attended the hearing represented by [redacted]. The tenant was telephoned several times on the number she provided on the tenancy agreement and used during the tenancy however none of the calls were answered.
As Ms Sisson had been served with the notice of hearing by email and this was the email address she provided as an address for service in the tenancy agreement, I approve the landlord’s application for substituted service and the hearing continued in Ms Sisson’s absence.
The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent?

The tenants did not give notice to leave the property but were observed doing so on the 19 th of April. The landlord took possession of the property the following day. Accordingly, I find the tenants liable for rent until 19 April.
The landlord has also sought compensation for the lack of notice. Given they did not give notice and left the property in a dirty and damaged state, the landlords could not re-rent the property for some weeks. They therefore got into severe financial stress as a result of Ms Sisson’s actions.
Pursuant to section 51(2B) of the Residential Tenancies Act 1986 (RTA) tenants are required to give written notice of at least 28 days before they vacate a tenancy. Accordingly, I consider the compensation sought justified and reasonable.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) RTA.
The landlord has proven in evidence that the property was left unclean and with a considerable amount of rubbish. Further, Ms Sisson did not return the keys when she left or when she was contacted post tenancy for them.
The amounts ordered are proven in evidence and accordingly ordered as sought. Filing fee
