The landlord’s representative attended the hearing today. The tenant did not attend. I continued in his absence because he has been posted and emailed notice of the hearing date and time and been sent text reminders.
The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
The tenancy ended on 16 October 2023 after the landlord gave notice of an intention to sell the property. The landlord says that the tenant did not move out until 30 October 2023.
The landlord provided rent records and water rates invoices which prove the amounts owing up to the vacate date. The tenant had been paying regular amounts towards water rates and the balance remaining is $108.64.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of a tenancy, the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish. The tenant did not return the keys so the locks were changed.
Also, the landlord proved that damage to the premises happened during the tenancy and is more than fair wear and tear. The damage is:- a. The front door frame was splintered and would not stay closed. b. One kitchen cabinet door was splintered around the hinge so the door could not be used properly. c. A large window in the lounge was broken. d. Two windows in one bedroom were broken. e. Other holes in walls and doors throughout the house.
I am satisfied that the damage is either careless or intentional. This means the tenant is liable. See sections 40(2)(a), 41 and 49B RTA.
The landlord has not claimed for cleaning or repairs of holes in walls and doors.
All invoices have been provided and are reasonable so are awarded in full. The damage amounts are less than the insurance excess (per event).
The landlord is also entitled to be awarded the filing fee as the claim has been successful.
The bond is refunded to the landlord.
The tenant may be able to set up a payment plan for the balance owing which will avoid debt collection costs.
No suppression orders were sought.
