I am satisfied that the tenant has been given appropriate notice of the time, place and purpose of the hearing and chose not to attend. I have determined the matter in the absence of the tenant pursuant to section 92(1) Residential Tenancies Act 1986 (RTA).

The landlord has applied for rent arrears, compensation, and reimbursement of the filing fee following the end of the tenancy.

The landlord must prove each claim to the civil law standard of proof, on the balance of probabilities.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.

The landlord sought compensation for the following items: a. Rubbish removal: $267.09 b. Lawns and garden maintenance: $317.40 c. Window cleaning: $184.00

The landlord provided photographs of the property at the end of the tenancy. These photographs show that the tenant did not leave the outside of the property in a reasonably clean and tidy state, and did not remove all rubbish.

The tenant left four tyres and at least four rubbish bins filled with rubbish outside the property. The rubbish bins that were filled with rubbish included two recycling bins. These bins contained recyclable and non-recyclable material. The landlord was unable to dispose of the rubbish with the recycling and had to organise for it to be collected and disposed of appropriately. The landlord provided an invoice of $267.09 for this work. The landlord’s claim for compensation for rubbish removal is granted in full.

The photographs taken at the end of the tenancy show that the lawns were overgrown and the garden needed weeding. The landlord provided an invoice of $317.40 for lawnmowing and garden maintenance. I consider that the tenant only needed to mow the lawns to return the outside of the property to a reasonably clean and tidy state. Therefore, I have granted the landlord’s claim for compensation for lawnmowing for an adjusted amount of $50.00.

The landlord’s application for compensation of $184.00 for window cleaning is dismissed. The photographs provided to the Tribunal do not show the windows in a significantly dirty state. A tenant is only required to leave the property in a reasonably clean and tidy state. They do not need to leave it in a pristine condition.

Because [The applicant/s] has substantially succeeded with the claim I have reimbursed the filing fee.
