Reasons

The landlord’s representatives attended the hearing today. The tenant was not present. I continued in her absence as notice of the hearing has been sent to her email address for service.
The landlord has applied for compensation and refund of the bond.
The landlord said that the tenancy ended on 14 March 2024 by agreement between the parties.
Photographs from tenancy inspections show that the house was damaged before the tenancy ended. There were 3 large holes in interior walls, several smaller holes, and three windows were broken.
I find the larger holes and broken windows to most probably be intentional and the rest of the damage to be at least careless. The person named as the tenant is legally held liable for damage caused by anyone at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
The inspection records also prove that a kitchen rangehood that had been installed new at the start of this tenancy, had been removed, and was missing at the end of the tenancy. I award compensation for the cost to replace and install this.
I award compensation for these repairs based on the invoices supplied.
The tenant is required to leave tenancy premises reasonably clean and tidy (including lawns) and remove all rubbish. The photographs show that the landlord had to do this work. I accept the invoiced detail that there were two heavy loads of rubbish to dump.
The landlord says that there was a flea infestation as cats lived at the house. Flea bombs did not work so professional treatment was needed.
I award all claims based on the itemised invoices supplied, and the filing fee.
The bond is refunded to the landlord and its name suppressed.
