Reasons

The landlord attended the hearing.
Telephone calls were made to the tenants on the number provided at the allocated hearing time. The calls could not be connected.
The Tribunal may hear matters in the absence of a party where satisfied that notice of the hearing has been given.
The tenancy ended on 29 November 2023. The application was filed with the Tribunal on 19 March 2023.
Section 91B RTA sets out the service requirements where an application is filed more than 2 months after the tenancy has ended. The service requirements have not been complied with by the landlord.
Section 91A (b) RTA provides that where the Tribunal is satisfied that all reasonable efforts have been made to serve the notice on the tenant it may dispense with further service and proceed as if the notice had been served in accordance with the RTA.
The landlord explained that up to 19 March 2024, the landlord was in contact with the tenant in an attempt to resolve outstanding issues including the bond. The landlord explained that she received an email from the tenant on 19 March 2024. The email address for the tenant provided to Tenancy Services as a service address is the same as the email address as in the email dated 19 March 2024. I think it is reasonable to assume that email notice to that address has been received by the tenant. The requirement for further service is dispensed with.
The landlord has applied for rent arrears, water rates and reimbursement of the filing fee following the end of the tenancy.

The tenancy ended on 29 November 2023. The landlord provided rent records and water rates invoices which prove the amount owing at the end of the tenancy was $2,180.00 for rent and $948.91 for water rates.
Further claims were filed by the landlord with Tenancy Services a matter of minutes before the hearing. Notice of those claims has not been served on the tenant and I am not prepared to consider them today for that reason.
As Tbt Property Management Limited has wholly succeeded with the claim I must order the tenant to reimburse the filing fee.
