The Bond Centre is to pay the bond of $2,000.00 (6425564-002) to Tbt Property Management Limited immediately.
[The tenant/s] must pay Tbt Property Management Limited $4,986.14 immediately, calculated as shown in table below.

Reasons

The hearing took place by telephone. Only the landlord attended the hearing. The tenant was called twice but did not answer. I am satisfied she has been served and the hearing proceeded in her absence.
The landlord has applied for termination, rent arrears and water rates, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
The landlord withdrew its application for termination.
The landlord says that the tenancy was due to end on 6 June 2024 by way of a 90-day notice but that the tenant was not ready to move out and therefore an extra week was agreed. The landlord says that the final day was agreed between the parties to be 13 June 2024. The landlord says the tenant told them to come to the property to inspect and do a final inspection with them on that day. On the basis of the landlord’s evidence, which I have no reason to doubt, I find that the last day of the tenancy was 13 June 2024.
The landlord provided rent records which prove the amount owing at the end of the tenancy in rent.
The landlord also seeks compensation for outstanding water rates.
The landlord had not updated their application and so I limited their application today to the sums set out in its application notice. This is because the tenant must be given notice of the claim bought against them. The landlord had not updated the information on the Tribunal application in any way (e.g. no additional invoices or information was filed despite the tenancy ending over a month ago).
At the hearing the landlord provided me with a water rates schedule and additional invoices which satisfied me that the water rate bills provided for the period claimed (which were estimates only) would not result in an over charge to the tenant. The amount ordered for water rates is up to and includes the sum in the invoice dated 4 April 2024
The landlord says it will seek to include the sums it was not able to pursue today (from 3 April to 26 April, 26 April to 5 June and 5 June to 6 June 2024) in a separate application they have filed.
Because Tbt Property Management Limited has wholly succeeded with the claim I must reimburse the filing fee.
