Reasons

There was a hearing for this matter on 19 August 2024. I issued an order that same day. Due to a typo, the total amount ordered to be paid by the tenant to the landlord as compensation was incorrect. The purpose of this order is to recall the original order dated 19 August 2024 and reissue it with the correct amount of compensation recorded.
The landlord attended the hearing. The tenant did not.
The landlord has applied for rent arrears, compensation, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent and water rates?

The tenancy ended on 5 April 2024. The landlord provided rent records and water rates invoices which prove the amount owing at the end of the tenancy. Rent was in arrears of $3,300.00 however, the landlord has already recouped the bond of $1,680.00. Therefore, I have only awarded $1,620.00 for rent arrears. Outstanding water rates were $845.34 at the end of the tenancy.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
The tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish.
The tenant did not return the keys.
The amounts ordered are proved.
I have deducted the cost of cleaning the oven and ceramic cooktop from the total amount ordered. The photographs provided to the Tribunal by the landlord at the end of the tenancy did not show these items were left in an unreasonably clean and tidy state.
Because Edgecom Limited As Agent For Litearmi Trust has wholly succeeded with the claim I must reimburse the filing fee.
