The landlord attended the hearing by video call.
The tenants were telephoned on the phone numbers provided but the phone calls went unanswered. I am satisfied the tenants were properly served with the application and notice of the hearing by email. The hearing proceeded in their absence.
The landlord has applied for rent arrears, water rates, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent and water rates?

The tenancy ended on 16 July 2024 being the day the tenant vacated.
The landlord provided rent records and water rates invoices which prove the amount owing at the end of the tenancy being $5,180,00 for rent arrears and $211.77 for water rates.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, pass cards or other such devices. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The tenant did not leave the premises reasonably clean and tidy and did not remove all their rubbish.
The landlord’s evidence was that the property was a mess, the bathroom smelt and the oven was not clean and some rubbish that required removal. The landlord submitted they spent 2.5 days cleaning the house and claimed.
The claim was for $1,242.00 and a commercial cleaners quote was provided in support of this claim.
I raised at the hearing that the Tribunal will generally compensate a landlord’s time and labour at the rate of $30 per hour. The property manager confirmed by email following the hearing that the landlord spent 20 hours cleaning the premises.
I consider $30 per hour is appropriate and I make an order for 15 hours as the tenant is only required to ensure they leave the premises in a reasonably clean and tidy condition. I consider 15 hours would have been sufficient to ensure the premises was reasonably clean and tidy. I expect the landlord would have cleaned the property to a higher level than required by the tenant as they are now residing in the premises. The amount ordered is $450.00.
The tenant did not return a garage door remote. The landlord provided a quote for the replacement and the programming of a new remote for $185.00 and I order this in full.
Pre and post tenancy inspection reports were provided in support of the claims.
The amounts ordered are proved. Bond
The bond is to be paid to the landlord immediately to offset the amount ordered. Filing fee
Because the landlord has substantially succeeded with the claim, I have reimbursed the filing fee of $27.00. Suppression
The landlord confirmed that name suppression was not sought.
