Reasons

The landlord attended the hearing represented by Mr Toa.
There was no appearance for the tenant, and he did not answer the calls made to his phone which rung out to voicemail. He had been notified of the hearing by letter and text, accordingly pursuant to section 92 of the Residential Tenancies Act 1986 (RTA) the hearing continued in his absence.
The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent and power?

The tenancy ended by Tribunal order on 10 June 2024 however the tenant remained one further day, accordingly that amount in rent is ordered.
The landlord also seeks the cost of having to employ the bailiff to enforce the eviction. I find this amount established in evidence and accordingly direct reimbursement of that cost.
The landlord further claims reimbursement for electricity costs. This tenancy had a check meter, but the neighbouring unit (8) received and paid the electricity bill. The tenant was asked on multiple occasions to provide his usage amounts so his allocation of the cost could be calculated, but he failed to do so.
His exact usage cannot be calculated as there is no evidence of the meter readings. The landlord claims compensation for the electricity the tenant used, particularly as he took evident steps to consume excessive amounts, for example he left the heat pump on at full power when he vacated. He failed to engage on the matter and took active steps to not meet his obligations.
The full amount of power used over both homes for the tenancy period was $1,764.94. I find that an award of $600 compensation for the 10 months the tenant occupied the property and failed to comply with the tenancy agreement by failing to advise of his usage amounts just 1 in the circumstances.
The landlord would be well advised to take the meter readings themselves should such a situation arise again. 1 Section 85 of the RTA

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) RTA.
The landlord has established in evidence that the tenant did not leave the premises reasonably clean and tidy, did not remove all rubbish and did not return the keys.
The amounts ordered are proven in evidence and considered just in the circumstances.
Because Grenadier Rent Shop Limited As Agent For H Buchanan And R Mccormack has wholly succeeded with the claim I must reimburse the filing fee.
