The Bond Centre is to pay $1,492.73 from the bond of $2,900.00 (5664512- 005) to The Rent Shop Limited immediately, calculated as shown in the table below:

Reasons

The landlord attended the hearing, conducted via teleconference. Two calls to the tenant went unanswered. I was satisfied adequate service had completed and I continued with the hearing after the second call also went unanswered.
The landlord has applied for termination of the tenancy for breach of the tenant’s obligations.
A claim for glass repair was withdrawn at the hearing.

Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.
Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.
The tenant has breached their obligations by failing to pay a significant water arrears total. Rent is up to date.
The landlord served a 14-day notice on the tenant on 23 February 2024, and the tenant did not remedy the breach within the required period.
It would be inequitable to refuse to terminate the tenancy because as the continued failure to pay water rates as due. Further, the tenant has served a notice to terminate effective 10 September 2024. While this advice was verbal, it makes sense to align the termination date in this order with that date.
The debt is paid via the bond with the balance remaining with the Bond Centre.
Because The Rent Shop Limited has wholly succeeded with the claim I must reimburse the filing fee.
