Kirsten took the call after previously advising the Tribunal she was unwell – her voice confirmed that however she remained on the call to confirm the vacated situation was as the landlord claimed. She also acknowledged the likely debt and her intention to pay it off via time payments. She was encouraged to discuss this monetary order with the other tenants, and the landlord, to make an appropriate arrangement.
The calls to Thomas and Brendon went unanswered and to voicemail. After the first call went to voicemail, a brief message was left introducing myself and explaining the purpose of the call. The message concluded with the advice I would try a second time after waiting some minutes. I was satisfied adequate service had completed and I continued with the hearing after the call went unanswered.
The landlord has applied for rent arrears, compensation, refund of the retained bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent?

The tenancy ended via a previous Tribunal order. The rent arrears at that date were paid from the bond.
The tenants remained at the premises for a further four days. The landlord provided rent records which prove the amount owing at the end of the tenancy was the final four days, calculated at $265.27. The actual total for four days should have been $285.71 but the previous filing fee paid via the bond was added to the rent arrears.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The tenant did not leave the oven reasonably clean and did not remove all rubbish. The landlord produced invoices and photos in support of the $80.00 for the oven clean and $419.75 for rubbish removal. The rubbish had been piled by the tenants and then dumped into a skip by the owner. The landlord only sought the skip costs.
The tenant did not return the laundry door padlock and key. These were replaced at a cost of $40.06.
