Reasons

Both parties attended the hearing. The Landlord attended by video and the Tenant by telephone.
During the hearing, the Tenant, Mr Porter became disruptive and verbally abusive. Mr Porter subsequently left the hearing by disconnecting their phone after refusing to accept the Landlord’s claim for cleaning.
The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent?

The tenancy ended on 14 August 2024. The landlord provided rent records to prove the amount owing at the end of the tenancy.
The Tenant disputed this rent arrears because they had moved out on 13 July 2024. The Tenant claimed they should not be liable for rent after they had moved out.
The Landlord submitted that the Tenant gave notice to terminate on 17 July 2024 and therefore rent was owing up to the 14 August 2024.
A Tenant may terminate a periodic tenancy by providing 28 days notice. Section 51(2B) Residential Tenancies Act 1986.
In considering the evidence, the Landlord provided a rent summary to prove the amount of arrears and I find it more likely than not that this is the correct amount of rent arrears outstanding. The Tenant also confirmed that he moved out on 13 July 2024 so it is more likely than not, that the Tenant gave notice early in July 2024 and the 14 August 2024 is the correct date of termination.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
The tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish. The Tenant left behind a lot of items including a couch, desk, coffee tables, utensils, a couch, bike and crockery. An ingoing and outgoing inspection report was provided. An invoice was also provided for the cleaning and rubbish removal.
The tenant did not return all of the keys so a lock required changing. An invoice was provided to substantiate the cost.
The amounts ordered are proved.
As [The applicant/s] has wholly succeeded with the claim the Tenant must reimburse the filing fee and the Landlord is granted name suppression.
