The landlord attended the remote hearing. The tenant did not. A call to the tenant’s last known number had no response.
On 26 August 2024, the Tribunal issued an order immediately terminating the tenancy, and refunding the bond to the landlord in partial payment of rent arrears and compensation. 1 The total for the tenant to pay under that previous order was $1,927.00.
The landlord now applies for compensation for the cost of cleaning and removing rubbish from the premises. The landlord also seeks reimbursement of the filing fee for this further application.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish. The landlord has filed an exit report which includes photos taken on 27 August 2024. The photos show the premises were not clean and the tenant left a large amount of perishable food, furniture, cutlery, and rubbish.
The landlord has provided an invoice dated 5 September 2024 for $920. The cost included two people removing the items left behind and loading them into a skip ($800) and four hours cleaning (at $30 per hour).
The landlord has also provided an invoice dated 17 September 2024 for $550 for the cost of a skip bin which was delivered to the premises on 5 September 2024 and collected later the same day.

The landlord states that at the time of the first hearing (for application 4960013) the tenant had abandoned the premises. 2 The landlord says tenant did not return to the premises and did not hand back the keys at the end of the tenancy.
