The landlord attended the hearing, conducted via teleconference. The call to the tenant went unanswered and to voicemail. It was not possible to leave a message.

This application was lodged after two months and additional service was required. Refer s 91A(2) Residential Tenancies Act 1986 (“RTA”). The landlord provided evidence of the use of a collection agency to successfully obtain a current address. A later attempt as service there was refused, the occupants claiming the tenants had left that address earlier.

Section 91B(2)(c) RTA provides the Tribunal may dispense with the requirement for service and proceed as if the notice or other document had been served on the party in accordance with this Act. I was satisfied the landlord has taken appropriate steps to attempt serve and it was appropriate to now proceed.

The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy. The tenancy ended after the terms of a conditional termination order were not met by the tenants. That order was not suppressed therefore it is not referenced in detail here, given the suppression in this order.

A previous attempt at debt collection has been unsuccessful after an initial agreement for a time payment of the debt was considered in place. This monetary order establishes the final debt for this tenancy and any prior order or agreement regarding this debt is incorporated into this order and are not to be separately enforced.

These photos support the extent of effort and cost incurred are as claimed. The cost is due to the tenants’ failure to leave the premises as required by s 40 RTA.
